1. Introduction and Identity of the Data Controller

This Privacy and Personal Data Protection Policy ("Policy") sets out our principles as Datapron Yazılım Reklam ve Internet Hizmetleri A.Ş ("Influencer Portal" or "Company") regarding the collection, processing, and protection of the personal data of content creators ("Influencer") who are members of our platform, brands ("Brand"), and other users visiting the platform, in compliance with the Republic of Turkey's Law No. 6698 on the Protection of Personal Data ("KVKK") and relevant legislation.

2. Which Personal Data Do We Collect?

Influencer Portal collects the following data based on the user type in order to provide its services:

● Influencer (Content Creator) Data:

  • Identity and Contact Data: Name, surname, email address, phone number, Turkish ID number (for billing/payment transactions).
  • Social Media and Profile Data: TikTok, Instagram, and YouTube profile links, usernames, follower counts, engagement rates, viewing statistics, portfolios uploaded to the platform, and campaign content.
  • Financial Data: Bank account details, IBAN, tax office, and billing information to deposit campaign earnings.

● Brand / Customer Data:

  • Identity and Contact Data: Brand representative's name, surname, email address, phone number, company title, role/department.
  • Financial Data: Billing information, payment records (Credit card data is not stored by us; it is securely processed by licensed payment institutions [e.g., Iyzico, PayTR, Stripe]).

● Automatically Collected Device and Usage Data:

  • IP address, browser type, log-in and log-out times to the platform, click and navigation data, and analytical data collected via cookies.

3. For What Purposes Do We Process Personal Data?

Your collected personal data is processed for the following purposes:

  • Performance of the Service: Creating Influencer and Brand accounts, receiving and publishing campaign requests (e.g., holiday campaigns).
  • Matching and Optimization: Finding Influencers with the appropriate profile (having the right target audience on TikTok, Instagram, YouTube) for Brand campaigns and managing the application processes.
  • Communication: Managing campaign briefs between parties, content approval processes, and revision requests via the platform.
  • Finance and Accounting: Receiving payments from Brands, distributing Influencer earnings when the campaign is completed, and billing processes.
  • Legal Obligations: Presenting evidence in potential legal disputes and fulfilling information requests from legal authorities.

4. Method and Legal Basis for Collecting Personal Data

Your data is collected via fully automatic or partially automatic methods through filling out registration forms on the platform, integrating social media accounts into the platform (API permissions), and correspondence/file uploads within the platform.

Your data is processed based on the following legal grounds specified in Article 5 of the KVKK:

  • It is directly related to the establishment or performance of a contract (e.g., User Agreement),
  • It is mandatory for the data controller to fulfill its legal obligations,
  • Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject,
  • Obtaining your Explicit Consent where required by law.

5. Transfer and Sharing of Personal Data

Your data is shared with third parties only to the extent required by the service, in a manner that will not compromise your security:

  • Sharing Between Brands and Influencers: When an Influencer applies for a Brand's campaign; their name, social media profile information, engagement data, and portfolio are shared with the relevant Brand representatives. (This is the main function of the platform).
  • Service Providers: Cloud infrastructure providers hosting our databases (e.g., AWS, Google Cloud), email distribution tools, and analytics partners (Google Analytics, etc.).
  • Payment Institutions: Licensed payment and e-invoice integrators for the secure execution of financial transactions.
  • Official Authorities: Authorized public institutions and judicial authorities due to legal obligations.

Due to the nature of digital services, personal data may be processed through service providers whose systems or headquarters may be located abroad (e.g., cloud, analytics, or platform providers), in compliance with applicable data protection laws and regulations.

6. Data Security and Retention Periods

Influencer Portal implements technical and administrative measures such as SSL encryption, firewalls, and authorization restrictions to prevent unauthorized access, loss, or manipulation of your personal data. Your data is stored for the duration of your platform membership and, after the termination of your membership, for the statute of limitations stipulated by the relevant legislation (e.g., Turkish Commercial Code, Tax Procedure Law) (typically 10 years).

7. Your Rights Under KVKK (Article 11)

Pursuant to Article 11 of the Law, our users have the right to:

  • Learn whether their personal data is being processed,
  • Request information if their personal data has been processed,
  • Learn the purpose of the processing and whether the data is used in accordance with its purpose,
  • Request the correction of incomplete or inaccurately processed personal data,
  • Request the deletion or destruction of personal data if the conditions are met.

8. Social Media Integrations and API (Application Programming Interface) Usage

Influencer Portal uses the official API (Application Programming Interface) services of YouTube, Instagram (Meta), and TikTok to verify the profiles of content creators (Influencers) on the platform, measure campaign performances (views, likes, comments, engagement rates, audience demographics, etc.), and provide transparent reports to Brands.

When users connect their social media accounts to Influencer Portal, they are deemed to have accepted the API terms of use and privacy policies of the respective platforms. In this context:

  • YouTube Integration: Our platform uses YouTube API Services. When you connect your YouTube account to Influencer Portal, you agree to be bound by the YouTube Terms of Service and Google Privacy Policy. Users can revoke Influencer Portal's access to their YouTube data at any time via the Google Security Settings Page.
  • Instagram Integration: The integration of your Instagram account is provided via the Instagram Graph API. By making this connection, you accept the Meta Privacy Policy and conditions.
  • TikTok Integration: The integration of your TikTok account is provided by official TikTok API services. When you connect your account, you accept the TikTok Privacy Policy.

Data Security Commitment: Social media API connections are made with "OAuth 2.0" or similar secure authorization protocols. Influencer Portal can never see, record, or store your social media account passwords. The system only accesses statistical data (follower count, public content, and campaign metrics) within the scope of permissions approved by you via the API, and does not use this authorization to share unauthorized content or perform transactions on your behalf.
